, josh, a different kind of union story. unions between same hif sex couples, obama administration coming to the conclusion that the defense of marriage act is unconstitutional. they won't defend it anymore. tell us what that means, especially for folks in california. >> what it doesn't mean is there thaw there will be an instantaneous affect on the prop eight. >> remind us. >> it was a constitutional amendment that defined marriage definetively as one man, one woman. currently under challenge. and a federal judge has found it unconstitutional under a couple of provisions of the 14th amendment. gone to the ninth circuit court of appeals. and they have bumped a question of legal standing over to the california supreme court, because the state has declined to defend it any further, the proponents would like to do that, but there is some question they are allowed. >> is this related to doma? >> no. doma is a federal statute, and prop eight is at the state level. we have the president of the united states opining that a federal law banning same-sex marriage cannot be constitutionally upheld.
states' influence at this point. you have been critical of the obama administration for not having a consistent message. what influence is the administration having an events there? >> well, i think the u.s., of course, has close ties to the u.s., but they are not going to determine the events in the streets of egypt. but i think, you know, everybody expects them to stand up for the basic universal values, freedom, democracy, rule oflaw, human rights and the u.s. at the beginning has been behind the curve. i think they caught up in the last few days, but the special representative made the statement yesterday saying president mubarak must stay in power. that came down here like a piece of lead. then it was denied by the white house. you know, it was retracted by the white house. i think what people expect is not that the u.s. will effect change in u.s. but they have to be very clear that they are on the side of the people for freedom and democracy, for egypt to move to what i call the second republic, a move from an authoritarian system into democracy. >> let me show you "the week"

. the number has grown to 733 businesses and unions that have received waivers for the obama care law. here's the problem, megyn. you good to the website, hhs.gov and you call it up and you see unions after unions, indiana u.f.c. local, united crafts benefits, united food, and then you come to the sciu. they have three waivers. here's a group that gave $27 million for mr. obama when he was running for president back in 2008. also, were the most vocal supporters for obama care during the debate and now they're asking for health care waivers for their own groups. 40% of the 733 names on this list are unions. that while only around 11% to 12% of the work force is unionized. let's call it overwhelmingly more popular on this list than the businesses. megyn: isn't that because of the mini med programs they offer? it started to unfold with companies like mcdonald's saying, we give them healthcare, but it's not big medical programs. and they would be penalized in a way that would make them choose getting rid of the policies or paying tons of dough. >> absolutely. megyn: the way i put it more nefari
